Christa Pike, the 50-year-old Tennessee woman who was supposed to be the first execution in the state in 200 years, is now awake and speaking nearly a week after failed attempts to execute her by lethal injection.
She survived the execution attempt on September 30 and has now been taken off a ventilator. Pike remains in intensive care and her long-term condition remains unclear.
According to her attorney, Pike, who remains handcuffed and shackled to her hospital bed while receiving medical care, has suffered severe damage to her arms during the procedure.
What happens next is far less clear.
Tennessee officials administered two doses of the sedative pentobarbital during the execution attempt, but Pike did not die. Medical experts have suggested problems with the intravenous lines may have caused some of the drug to enter surrounding tissue rather than reaching her bloodstream as intended.
Her survival appears to make the case unprecedented in the modern US death penalty system.
There have been other executions that were abandoned after officials struggled to establish IV access. Pike’s case is different because the execution drugs were actually administered before the procedure failed.
That distinction could now become central to a legal fight over whether Tennessee can attempt to execute her again.
Pike’s lawyers are seeking a court order requiring officials to preserve evidence from the procedure, including needles, drug information and execution records. They have also renewed their request for Governor Bill Lee to commute her death sentence to life without parole.
Governor Lee has already halted Tennessee’s remaining executions for the year and ordered an independent investigation into what went wrong.
Pike was sentenced to death for the 1995 torture and murder of 19-year-old Colleen Slemmer, her fellow student at a Knoxville Job Corps programme. Pike was 18 at the time.
